WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT

Player Name: _____________________________________________________________ (“Player”)

In consideration of being allowed to participate in on-ice and off-ice hockey programming, related events and/or team activities (all, collectively and without limitation, the “Hockey Activities”) organized by Rochester Youth Hockey League, Inc. and/or Rochester Grizzlies (collectively, the “Rochester Coalition”), the undersigned certify(ies), acknowledge(s) and agree(s) as follows:

1. General Acknowledgments; Player Condition; Authorization. The named Player is physically able to participate in Hockey Activities and, to my/our knowledge, there are no restrictions, physical impairments, or any other facts which may in any manner limit his/her participation in same.  The Rochester Coalition will rely upon the acknowledgments and agreements set forth in this form and on the recurring COVID-19 self-certification measures described in Paragraphs 2 and 3 below.  I/we acknowledge and agree that Player and/or Participant (as defined herein) may be temporarily removed from participation in Hockey Activities by the Rochester Coalition in the event of an identified COVID-19 Threat (as defined below), pending implementation of appropriate quarantine measures and return-to-play protocols.

2. COVID-19 Acknowledgments; Compliance Required.  For the duration of, and as a condition precedent to participation in any and all Hockey Activities during, the 2020-21 season, the Rochester Coalition requires that the Player, along with anyone related to or associated with the Player who is participating in any Hockey Activities (including without limitation Players, coaches, managers and other team officials, parents/grandparents/guardians, anyone accompanying players, and friends and/or spectators) (collectively, “Participants”):

1. acknowledge and agree to comply with all Rochester Coalition screening and reporting procedures set forth below;
2. acknowledge and adhere all Rochester Coalition safety protocols set forth below;
3. acknowledge and agree that the Rochester Coalition may, and is authorized to, take all measures deemed appropriate for the protection of our players, teams, organizations and the general public, in the event of a COVID-19 Threat;

3.COVID-19 Screening and Reporting; Compliance Required at ALL Hockey Activities:  Player and all Participants certify, acknowledge and agree to adhere to and implement the following COVID-19 related compliance procedures, and hereby make the following certifications, notifications and representations relating to COVID-19, for and at each and every game, practice or other event constituting Hockey Activities, for the entire duration of the 2020-21 hockey season (each and all, a “COVID-19 Threat”):

1. Any Player and/or Participant shall self-report to the Rochester Coalition (via designated email ) if he/she/they have tested positive for COVID-19 or have been exposed to an individual with COVID-19 in the previous fourteen (14) days.
2. Any Player and/or Participant shall be able to confirm, and does hereby confirm, that he/she/they have not traveled, in the last 14 days, to any location that New York State then-currently has designated as requiring a 14-day self-isolation after returning from that location, due to COVID-19.
3. Any Player and/or Participant shall be able to confirm, and does hereby confirm, that he/she/they have not experienced any symptom commonly associated with COVID-19 in the past 14 days, including without limitation: (i) fever (>= 100.4 degrees Fahrenheit); (ii) chills; (iii) cough; (iv) shortness of breath or difficulty breathing; (v) fatigue; (vi) muscle or body aches; (vii) headache; (viii) sore throat; (ix) recent loss of taste or smell; (x) congestion or runny nose; (xi) nausea or vomiting; or (xii) diarrhea.
4. Any Player and/or Participant covenants, acknowledges and agrees that, following a positive test for COVID-19 and required quarantine, he/she/they will require approval from the Rochester Coalition prior to resumption of participation in Hockey Activities.

4. Financial Responsibility & Insurance. The undersigned represents, acknowledges and agrees: (a) that he/she/they bear sole and exclusive financial responsibility for any medical attention needed during Hockey Activities or resulting from an injury received or illness suffered during participation in Hockey Activities, including without limitation from or relating to a COVID-19 Threat; (b) that he/she/they have and maintain adequate health and medical insurance coverage for Player, which covers any and all involvement in Hockey Activities; (c) that his/her/their medical insurance shall be the insurance coverage for any medical treatment necessitated by participation in Hockey Activities; (d) that the Rochester Coalition and its constituent organizations shall not assume, or be responsible or liable for, any expense, medical treatment, or compensation for any injury to the Player during participation in Hockey Activities; and (e) that the risk of injury from the Hockey Activities may be significant, including the potential for permanent bodily damage, paralysis and/or death.

5. Safety Protocols.  The undersigned represents, acknowledges and agrees to abide by and facilitate all of the following safety protocols, for the duration of the 2020-21 season (collectively, “Safety Protocols”)

1. All Players and Participants shall practice social distancing (6 ft.) wherever possible, especially in common areas. (This won’t apply to players engaged in on-ice Hockey Activities.)
2. No handshakes/celebrations/spitting. Players and Participants will refrain from handshakes, high fives or any celebrations that could result in contact. Players and Participants will refrain from spitting
3. All Players and Participants shall wear face masks whenever applicable. (This will apply to coaches, but won’t apply to players, while engaging in on-ice Hockey Activities.)  Masks must be worn to and from the rink, including by Players.
4. Hand washing and/or use of hand sanitizer upon entrance/exit of the facility, during Hockey Activities, and prior to and after eating is highly recommended.
5. Player and Participants will endeavor to avoid touching the face, including your eyes, nose and mouth.
6. Players MUST bring water bottles with them for all Hockey Activities. Water bottles MUST be clearly labeled with a player’s name and MUST NOT be shared  with any other individual.
7. Players should remain in their cars until just prior to the start of Hockey Activity session, to avoid gathering in large groups. Drop off and pick-up times may be staggered such that the number of attendees arriving and leaving at the same time will be minimized. At the conclusion of Hockey Activities, please proceed directly to your car and do not congregate around the entrances or exits.
8. Players and Participants will limit the number of spectators who attending Hockey Activities (including without limitation games).  Each Player shall be accompanied by no more than 2 people, to limit the size of crowds and to mitigate the risk of transmission of illnesses.

6. Knowing Release; Assumption of Risk. THE UNDERSIGNED KNOWINGLY AND FREELY ASSUMES ALL RISKS, both known and unknown, even if arising from participation in Hockey Activities, including without limitation the acts, omissions or negligence of the Releasees (as defined below) or others, and assume full responsibility for Player’s participation in Hockey Activities. The term “Releasees” as used in this Waiver, Release and Assumption of Risk Agreement means collectively Rochester Youth Hockey League, Inc., the Rochester Grizzlies, and their respective affiliates, officers, directors, successors, employees and agents.

7. Waiver, General Release and Indemnification.  The undersigned, for himself/herself/themselves, and on behalf of any respective heirs, assigns, personal representatives and next of kin, HEREBY WAIVE, RELEASE, INDEMNIFY, AND HOLD HARMLESS each and all of the Releasees, from and against any and all claims, demands, costs, expenses, losses, or liability arising out of or related to any property damage, injury, illness, disability, death or loss of any kind that he/she/they may suffer (collectively, "Losses"), WHETHER ARISING FROM THE ACTIONS OR INACTION (INCLUDING NEGLIGENT ACTIONS OR INACTIONS) OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law,  including without limitation any and all Losses derived from or relating in whole or in part to a COVID-19 Threat or the contracting of or exposure to COVID-19 while involved or participating in Hockey Activities In this regard, the undersigned hereby agree(s) to hold Releasees harmless and indemnify and defend same against any and all Losses, claims, liabilities, damages, liens, and expenses (including, without limitation, reasonable attorney's fees) arising directly or indirectly from any such occurrences.

8. Governing Law and Venue.  This Waiver, Release of Liability and Assumption of Risk Agreement shall be governed by New York law and any action arising herefrom shall be venued in the federal or state courts located Monroe County, New York.  The undersigned consent(s) to such venue and jurisdiction and waives all rights to contest same, including without limitation by an allegation of inconvenient forum.

THE UNDERSIGNED HAS READ THIS WAIVER, RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND(S) ITS TERMS, UNDERSTAND(S) THAT SUBSTANTIAL RIGHTS MAY HAVE BEEEN RELINQUISHED BY SIGNING IT, AND SIGN(S) IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I, as parent/guardian with legal responsibility for the Player above named, do hereby consent and agree to his/her waiver, release and assumption of risk as provided above, and, for myself, my heirs, my spouse (if applicable), my family assigns, and next of kin,  I hereby irrevocably waive and release and agree to indemnify and hold harmless the Releasees from any and all Losses related to my, my family’s and/or my minor child's involvement or participation in Hockey Activities, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES and EVEN IF RELATING TO OR DERIVED FROM EXPOSURE TO OR CONTRACTNG OF COVID-19, all to the fullest extent permitted by law.  I covenant and agree to adhere to and comply with all COVID-19 compliance requirements set forth above for myself and Player, and to self-certify regarding and, as applicable, timely report, any and all COVID-19 Threats (as defined above), all for the duration of the 2020-21 season.

ACKNOWLEDGEMENT BY HEAD COACH OF PLAYER’S ROCHESTER COALITION TEAM

I, in my capacity as the Head Coach, do hereby acknowledge the waiver executed by Player/Participant/Parent/Guardian as set forth above.  I hereby irrevocably waive and release and agree to indemnify and hold harmless the Releasees defined above from any and all Losses related to my involvement or participation in Hockey Activities as a Head Coach, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES and EVEN IF RELATING TO OR DERIVED FROM EXPOSURE TO OR CONTRACTNG OF COVID-19, all to the fullest extent permitted by law.  I covenant and agree to adhere to, and to facilitate Player’s and my team’s compliance with all COVID-19 compliance requirements set forth above, and to timely report to the Rochester Coalition (by email to ryhcovid@gmail.com), any and all COVID-19 Threats (as defined above), all for the duration of the 2020-21 season.
